The Government's New Right to Track Your Every Move With GPS

Government agents can sneak onto your property in the middle of the night, put a GPS device on the bottom of your car and keep track of everywhere you go. This doesn't violate your Fourth Amendment rights, because you do not have any reasonable expectation of privacy in your own driveway - and no reasonable expectation that the government isn't tracking your movements.

That is the bizarre - and scary - rule that now applies in California and eight other Western states. The U.S. Court of Appeals for the Ninth Circuit, which covers this vast jurisdiction, recently decided the government can monitor you in this way virtually anytime it wants - with no need for a search warrant....

It is a dangerous decision - one that, as the dissenting judges warned, could turn America into the sort of totalitarian state imagined by George Orwell. It is particularly offensive because the judges added insult to injury with some shocking class bias: the little personal privacy that still exists, the court suggested, should belong mainly to the rich.

This case began in 2007, when Drug Enforcement Administration (DEA) agents decided to monitor Juan Pineda-Moreno, an Oregon resident who they suspected was growing marijuana. They snuck onto his property in the middle of the night and found his Jeep in his driveway, a few feet from his trailer home. Then they attached a GPS tracking device to the vehicle's underside.

This is obviously out of hand.

I said it on another forum, I'll say it again. Repulsive. Absolutely repulsive.

A man said to the universe:
    "Sir, I exist!"
    "However," replied the universe,
"The fact has not created in me
    A sense of obligation."

How can there not be a reasonable expectation of privacy in your driveway? I assume that a reasonable person would have a problem if their neighbor started parking his car in their driveway. This can't be for any reason other than that the individual considers his own driveway to be private.

    Ridiculous.

I can hear the ads already: "Have you done your part? Report any suspicious activities to your local neighborhood monitoring agency. It's the law!"

    Hahahha, I mean, serious.

Do you even understand how GPS's work? You think they are magical devices not needing anything, always powered and prepared to find YOU!!!

And YOU, of course, are VERY important in the world of over 6 billion people...

Even if this silly fantasy would work, whats the deal? What right do you have to NOT be found?

Out of hand, just out, of, hand....

What really makes me a bit sad is that you, Grandpa, that usually show quite a deal of intellect and understanding (you do not seem to believe in gods and fairies and such) seem to think that the "New World Order" is after you and you run in panic.

Tell me, about above quote from article, What kind of battery will this reciever be using? I mean, it needs a really really good one to keep going for, well, to be useful... Like a mini Nuclear Powerplant? .... Maybe.. Fission?

Who cares? Even one second of tracking my car without a warrant is immoral as hell.

    "Sir, I exist!"
    "However," replied the universe,
"The fact has not created in me
    A sense of obligation."

If they can install GPS in a cellphone and modern cars have both computer and cellphone in them.

Innovative technology and the freedom to trade. It is a corner stone of the american dream.

What I don't understand is how they were convinced that your driveway, isn't private property? Sitting in my car, in my driveway listening to tunes, I do have a reasonable expectation of privacy. I am in my personal private property on my personal private property. I could see where an argument could be made if you park on a public street.

I was unaware that the government could trespass on private property without a warrant or probable cause any time they feel like it.

I think you missed the point, you need energy.

For your GPS to work (it would either be a GPS or GPS Reciever) in your cellphone you need to ACTIVATE IT else it wont work (obviously), or HAVE YOUR PHONE ON (else it wont work, no battery) and make sure you are in a Viable area for the Signal to Find you (not very hard to screw up a GPS signal).

And once again, 6 Billion people, we have about 300 million in the U.S, you are worried they gona "track you"? Seriously.

I don't think they'll want to track us all. Just the people they want to track. Take that how you will.
