I agree terrorists are not "people fighting an invading army inside their own country", these would usually be patriotic insurgents struggling against an occupation.

I don't have enough specifics to identify the backgrounds of each and every alleged POW suspected of terrorism who is thought to have been denied GC rights.

What does intrigue me is what would be expected to result from applying the GC. The captives would still have to be held until cessation of hostilities, then returned to the opposing party (the insurgency?) if they won. Given that there are a number of them who are not Iraqi, what do you think might happen to them if at the end of hostilities the government to whom these guys get repatriated when the Americans withdraw is their puppet and doesn't regard the terrorist insurgents as a great help to their cause?

An interesting question. I would tend to believe that even a U.S. puppet government in Iraq will be treading on thin ice for a while though. I doubt that they would want to inflame the issue of repatriated "terrorists" by prosecuting these people. I believe they would issue a blanket amnesty to all prisoners the U.S. releases (if we even release all of them) in the spirit of "with malice towards none, with charity for all". The non-Iraqis would simply be sent home to their countries of origin. I guess a lot depends on how the war progresses and what public opinion in Iraq is like after the imposition of such a puppet government. A lot of people seem to believe that the war will be finished as soon as elections are held in Iraq, but I don't think things will actually change that much.

In Afghanistan there wasn't much of this "with malice towards none or charity for all", remember the containers found full of Pakistanis buried in the desert? And I'd wonder how the receiving governments would handle this too, looking over their shoulders to check and see whether the US was watching, approved of their handling. Some captives have been released to various governments claiming their citizenship. In the cases involving naturalized citizens of western countries they seem to get held for a while, questioned and then released. They then go and try to sell their story to the media. In non-western countries where concern for US approval is greater and where traditions relating to suspects are different the outcome could be vene worse than continued imprisonment.

Wow.

It is almost amusing to hear about all the dirt coming out about Kerik. He received generous "gifts" from friends doing business with the city, which he never reported. His friends had known mob connections. He was also apparently conducting two extra-marital affairs simultaneously. There are also questions about his activities in Saudi Arabia where his contract was terminated suddenly. And then there are the various allegations regarding his activities in the Dpeartment of Corrections.

I guess no one thought doing a background check was necessary prior to announcing the nomination. I am sure this is going to mess up the Miramar bio-pic under development.

I'm amused to read authorities only "suspect" this NJ construction company may have mob ties, I thought all construction companies out there were mob operations.
