| Principled Observer Location: Toledo, Ohio Posts: 13,873 | Supreme Court decisions are of NO RELEVANCE if they go AGAINST THE WRITINGS OF THE CONSTITUTION. This is the fundamental point no one seems to understand. Take a look at documented history, and see when and where the federal government stepped outside their jurisdiction per the Constitution for the first time in each case. Abraham Lincoln, who enacted our first act of martial law, also signed some of the first "Executive Orders" which had to be done as Congress was not in session due to the beginning of the Civil War. He opened a small door of opprotunity, a sidestep clarification of the Constitution, and was assasinated before he could close that door. That door has been viewed by most all presidents since, but some truly exploited it, people like Wilson, Roosevelt, and others who believed in socialist themed programs. This door is the wrench of the checks and balances of our system. Constitutional, or Common Law, supercedes ALL LAWS. If any law stands in direct conflict with the Constitution, REGARDING ANY PREVIOUS PRECEDENT IN ANY COURT RULING, IT IS INVALID. There is only one way to change this, and is clearly written in the same said document, the Constitution. This is the part lawyers, judges, and others who help foster the current system, become upset. Never the less, it is FACT. There were over 470 changes made in Federal Laws, to allow the passing of the War and Emergency Act, and the Federal Reserve, no changes to the Constitution, however, therfore, they are technically, legally, and bindingly UNCONSTITUTIONAL, and can be removed by the will of the people AT ANY TIME, should they demand it less government not act in its OWN BEST INTREST. This system was not made to bear the concept of a "Strong Executive Branch", therefore has been unconstitutional for the last 71 years, at least. Executive Orders = Unconstitutional. Fast Track Legislation = Unconstitutional Inter-Governmental Public Funded Agencies = Unconstitutional 97.9% of modern American Government = Unconstitutional My opinion, based on my research.
