TALLAHASSEE -- A neutral notice that tells voters the names of all candidates seeking to replace disgraced U.S. Rep. Mark Foley in Florida's 16th Congressional District may be provided at polling sites on Election Day, an appeals court ruled Friday.
Foley's name will appear on the Nov. 7 ballot, even though he has resigned. The name of his replacement as the Republican candidate, Joe Negron, won't be on the ballot, but votes cast for Foley will count for Negron.
State officials had suggested to local elections supervisors that they provide notices explaining the vote.
Democrats, however, had sought to prevent the notices, saying it would be akin to giving voters a last-minute plug for Negron.
The Democratic candidate is Venus entrepreneur Tim Mahoney.
A three judge panel of the 1st District Court of Appeal ruled that notices were fine if they include other candidates names, too.
The court said supervisors may post signs that say:
"A vote for Mark Foley (Rep) will be counted for Joe Negron (Rep), the Republican candidate. A vote for Tim Mahoney (Dem) will be counted for Tim Mahoney (Dem), the Democratic candidate. A vote for Emmie Ross (NPA) will be counted for Emmie Ross (NPA), the no party affiliation candidate."
