My statement was accurate and in NO WAY an indication I am a "holocaust denier" as you so slanderously put it. If you you made this statement in public, I would sue you and win. Should I pull up my posts regarding my contempt for Hitler and his documented atrocities for you to see or do you want to keep slandering me? I think an apology is in order. |

And I will state for the record that I think most atheism is not necessarily a "non belief" in God, rather, an admission that they simply don't know the answers to life's questions. The problem is people evolving from not believing in God to believing that they are or can become God, developing a deep contempt for humanity in many cases. "Atheism" may annoy me somewhat, but megalomania is the true enemy. |

State (255 A.D.2nd 878, 680 N.Y.S.2nd 355) says that in order to prove libel and slander, the plaintiff must prove by preponderance that the defendant's comments were not only false but made with malice, that is, intending to cause damage. The case is binding in 4th Department of NY, where I live and thus the jurisdiction where the comment was written. I suspect that even if you could establish a different jurisdiction, there would be similar case law. Model civil and penal codes generally have libel and slander requiring four elements: 1) a published statement; 2) that is untrue; 3) and causes harm; 4) and was made with a malicious intent. There would be a massive uphill battle, taking the entire thread into evidence, to both prove that my statement was patently false and malicious based upon what you said. It's a matter of escalation of venue. My statement was in response to a statement that (I could show) a reasonable person could read and infer that you are questioning the scope of the WWII holocaust. I posted a reply to your statement in the same thread, read only by people who had read your original statement. That further conversation bore out that you were not, in fact, a denier, would actually go toward my side of the case, since it tends to show that my comments were not malicious. On the other hand, your obsenity-laden post that contains virtually no factual information would certainly not help your case. Don't forget...
