If you engage in necrophilia , since the person is technically no longer a person theyre a corpse , is it rape???? Inquiring minds want to know ?

Well, it is kind of funny in the context of shoplifting, a prostitute does sell sex. Plus, I doubt the dude actually raped a prostitute and is comeing to us for legal advice.

I don't want to be an a**hole about this, but just because the person in question "sells sex" it doesn't follow that raping them is "kind of funny". I've made my point. There is little to add except that if I caught the OP raping a "working girl" I would do what I could to pull the bastard off her. Would you? I suspect you would. As would Isherwood, I don't doubt.

I have not found the act of rape to be funny in many contexts, but that's not the funny part here, its the comparison of shoplifting, stealing a product, to stealing a prostitute's "product". It's not a joke for everyone, it requires some amount of immaturity, or whatever isherwood and I have in common that makes us find it funny in a horribly dark way.

And Yes, I'd imagine I'd do quite a bit more than pull him off, for some reason breaking an arm and castration come to mind, but then again I probably wouldn't stop to ask "I know you're probably anxious, but I have a few questions about your sexual habits" There's the dark humor again.

The question could easily be taken as absurd, and in that vein I found it humorous (yes, darkly humorous). I mean, come on, who would seriously ask if raping a hooker was shoplifting? The context suggested an absurd situation I found funny.

Also in states where prostitution is legal it would viewed as kidnapping and you would have to pay for the service provided which you stole.

I assume, but do not know of any cases about that. Most postitutes have a bodyguard (pimp) who would prevent that from happening, the basic rule being - pay the lady or get your legs broken.

I'd say rape. A prostitute has every right to say no to a prospective customer. That is, the deal has to be made before the desired price is set. Without that deal, without that consent, it just isnt shoplifting. Its also rape no matter what.
