Iraq prisoner abuse 'was routine'

The torture of prisoners in US custody in Iraq was authorised and routine even after the Abu Ghraib scandal came to light, a US-based rights group says.
Soldiers' accounts show that detainees routinely faced severe beatings, sleep deprivation and other abuses for much of 2003-2005, Human Rights Watch says.
Soldiers who tried to complain about the abuse were rebuffed or ignored.
But a Pentagon spokesman said 12 reviews had found there was no policy condoning or encouraging abuse.
As it says authorised and routine .

The 1949 Geneva Conventions permit the detention without charge of prisoners of war and other detainees only in the case of an international armed conflict—which by definition is between governments—or an occupation. Washington says that both will come to an end on June 30, meaning that the ongoing conflict between the Iraqi government and Iraqi insurgents would become a civil war. That a sovereign government may seek assistance from foreign governments does not transform a civil war into an international conflict. In the absence of an occupation or an international conflict, no one can be detained under international humanitarian law without being charged with a recognized crime. Those not charged must be released and repatriated “without delay.”
“The Bush administration can’t have its cake and eat it too,” said Kenneth Roth, executive director of Human Rights Watch. “If the occupation is over, so is the U.S. authority to detain Iraqis without criminal charges.”

In a dramatic reversal, a US House of Representatives panel on Wednesday endorsed Bush's plan for tough interrogations and trials of foreign terrorism suspects after Republicans rounded up enough members to turn defeat into victory.

Bush wants the authority from Congress to allow a program of CIA interrogations and detentions that critics have said amount to torture. The White House denies the program involves torture. The US Supreme Court in June struck down Bush's original plan.

I wonder how this will be interpreted, it seems to endorse Bushian views.
