Soldier jailed for activist death

http://news.bbc.co.uk/1/hi/uk/4140586.stm

Quote:
An Israeli ex-soldier who killed UK peace activist Tom Hurndall in the Gaza Strip has been jailed for eight years.
Ex-sergeant Taysir Hayb was convicted of manslaughter at an Israeli military court in June for shooting Mr Hurndall, of north London, in April 2003.
According to witnesses, Mr Hurndall was shot in the head as he acted as a human shield, escorting children away from gunfire. The court heard Hayb fired at him from an Israeli army watchtower, using a sniper rifle with a telescopic sight.

The Israeli army initially disputed this account.

Manslaughter? I guess killing an unarmed man with a scoped rifle isn't first degree murder if you wear an IDF uniform.

Quote:
Former IDF soldier Taysir Hayb was sentenced by a military court to eight years in prison for manslaughter in the fatal shooting of British activist Tom Hurndall in April, 2003.

The case marked the first time a soldier has been found guilty of killing a foreign citizen during more than four years of Palestinian-Israeli violence.

Hayb, who was convicted in June for shooting the pro-Palestinian activist in the head during an army operation in the Gaza Strip, received ten years for manslaughter, three years of which were a suspended sentence.

Hayb, a Beduin Arab, was sentenced to an additional year for obstruction of justice and six months of that offence was suspended, leaving him a total of eight years in prison.
Yes " The case marked the first time a soldier has been found guilty"

But more importantly is "Hayb, a Beduin Arab". If not an Arab would he have faced charges. Would he have been found guilty. These are not questions. Israel is racist.

An amendment to the Citizenship and Entry into Israel Law (Family Reunification Law) was also approved by 59 Israeli lawmakers on 27 July. It bars family unification for Israelis who are married to Palestinian women aged under 25 and to Palestinian men aged under 35.

This law discriminates explicitly against Palestinians and also implicitly against Palestinian citizens of Israel, who constitute some 20 percent of the Israel's population, and against Palestinian Jerusalemites
So its OK to have a Beduin Arab found guilty of murder. Doubt my belief that Israel is Racist?

Check out the last paragraph of the JERUSALEM POST
Quote:
Hurndall was a member of the International Solidarity Movement, whose activists often place themselves between Israeli forces and Palestinians to try to stop the Israeli military from carrying out operations, ignoring orders to leave closed areas. Israel complains the protesters are endangering themselves and the soldiers with their activities.
So, peaceful activist=endangering themselves=dead and so justified except for a Beduin Arab, who is sacrificed. Sound like another type of suicide mission.

I'm learning that the best is always in the last paragraph. Then you know that they REALLY think.

Did you read the case and all the reports to decide its was not manslaughter? Or for you IDF soldier always guilty and he do everything on purpose and there is no place for mistake?

A mistake with a scoped rifle? I don't excuse anyone in uniform when unarmed civilians are gunned down. With a scope you can see clearly that the victim is unarmed and not threatening. IDF has a history of killing unarmed civilians, doesn't it? And you, shrike, have a history of defending every g*d damned thing your nation does.

The fact that this is the first soldier prosecuted for assaulting foreign aid workers says something in itself. I don't believe the guy who drove a bulldozer that crushed that American girl, Rachel Corrie, was ever prosecuted - can anyone remember her?

PH, your right but the devil is in the detail. We're lucky it even got to court at all. If Hayb was not a Bedouin Arab, and given Israeli ability to turn the other eye away from IDF daily crimes, murder included, then manslaughter is as good as it gets for 'scoped' murder.

Israel is a racist society. It's official according to Amnesty. Shriky mustn't be discouraged from defending the indefensible. Else how could I go on repeating that Israel is racist! Yes i remember her.Did you saw the video from the doser?
The IDF produced a video about Corrie's death that includes footage taken from inside the cockpit of a D9. It makes a "credible case," writes Hammer, who has not seen the video, that "the operators, peering out through narrow, double-glazed, bulletproof windows, their view obscured behind pistons and the giant scooper, might not have seen Corrie kneeling in front of them," (Mother Jones). ISM disputes the contents of the Mother Jones article

Matt and shrike, a little off topic about Rachel Corrie, but here's her memorial website: http://www.rachelcorrie.org/news.htm

And shrike, the appeal would be IDF soldier Hayb appealing his sentence, not the prosecutor appealing a conviction. I did not read the trial documents, but don't you think that something seems wrong here, with a manslaughter sentence for gunning down an unarmed man trying to get kids to safety?

Imagine if you can, a Palestinian sniper shooting an unarmed Israeli to death. In your mind is this a mistake or an act of out-and-out murder?

Thank for the Rachel Corrie memorial website: Another very good person with her life tragically cut short. Just one

Settlements and settlers are illegal under international law. The Fourth Geneva Convention, the primary document governing the OPT, stipulates in Article 49 that the transfer of the population of the occupying power into the occupied territory is in breach of international law. The International Court of Justice confirmed in its 2004 judgment that settlements and settlement activity is illegal.

Freedom of movement is a right afforded to Palestinian civilians under the Fourth Geneva Convention as well as under established international treaties on human rights. Preventing free movement of people and goods interferes with the right to work, the right to health, the right to education, the right not to be held as a prisoner without a free and fair trial.
from Israel seals off Gaza, marks beginning of disengagement from Rachel Corrie memorial website.

Will her sacrifice save the US from Palestine anger?

Tom Hurndall was my next door neighbour : and no, shooting someone in the head with a JHP round is NOT manslaughter.
