Why not offer him a choice, continue his sentence or accept the option to take his own life and be "set free" via death?

He knew he was risking such a thing by tempting the laws about aiding what can be called murder. He however should be set free from jail if his probation instructed him not to voice any more opinions or advice about suicide.
