They can get all those legal rights by creating a legal contract and that can be done without a marrage ritual.
So can heterosexuals. I want government out of the marriage business entirely.

We need judges not Goddesses and Gods. So in the case of that one person then McCain has a point that we need judges that at least try to honor the Consitutional standards.
They can start by not presuming to replace the intent of the founding fathers with their own damned opinions like they did when they defined "public use" as meaning a city can take your property and sell it to a developer just because they'll get more in property taxes from the developer.

Of course wisdom has always been a factor in the make up of a good judge, wisdom that has a sense of fairness which is in fact what the spirit of the Consitution is all about. If the ruling reflects the spirit and intent of the consitution for fairness and equality, then that is better then some lawyer's fundamentalistic interpretation which might violate common sense.
The only correct interpretations of the Constitution are those of the people who wrote and/or ratified it. Of course, there is an amendment process built into the Constitution and if the American people want the federal government to have more powers or different powers, then all I ask is that they use the amendment process.
