| Igneous Magma | Huckabee and supporters: screw the Constitution! Something which bothers me greatly about Huckabee’s adopted tax plan is, it is designed to follow the same path of those who gave us the income tax. Keep in mind the goal of those who pushed the 16th Amendment was to remove the rule of apportionment as applied to “incomes“, the rule of apportionment being our Constitution’s fair share formula, for any general tax among the states!
What must never be forgotten is our founding fathers intended to allow Congress to raise its revenue from imposts and duties at our water’s edge, and also allowed for miscellaneous internal excise taxes on articles of consumption, but if Congress ever found it necessary to call upon the people within the various states in a general tax among the states, Congress was to first establish the total sum needed to be raised and then send a bill to each state based upon a formula which tied taxation and representation together by the same standard ____ each state’s population size!
That formula, considering subsequent amendments to our Constitution may be represented by the following formula:

Total U.S. Population
The fairness of our Constitution’s fair share formula is found in the fact that it turns out to be an equal per capita tax! If the tax were to be paid directly by each person living in the United States and a person living in New York paid one dollar, a person living in Pennsylvania would likewise pay one dollar!
In addition, it should also be noted our founding fathers also intended, rather than have federal tax collectors enter the states and levy each states share of the tax, our founders wanted to insure that once each state’s share of the tax was determined, the various states would be left to meet their responsibility in the general tax among the states in their own chosen way within a time period set by Congress.
This is what federalism, our Constitution’s plan, is all about___ the people within their states being left free to make their own decisions through their own political process, and especially when it comes time to meet a federal tax burden laid among the States. These intentions were repeatedly stated during the framing and ratification process of our Constitution. For example: Mr. George Nicholas said: "the proportion of taxes is fixed by the number of inhabitants, and not regulated by the extent of territory, or fertility of soil ___ Each State will know, from its population, its proportion of any general tax as it was justly observed by the gentleman over the way, (Mr. Randolph), they cannot possibly exceed that proportion; they are limited and restrained expressly to it. The state legislatures have no check of this kind. Their power is uncontrolled." ___3 Elliot, 243, 244.
Mr. Madison remarked that "they will be limited to fix the proportion of each State, and they must raise it in the most convenient and satisfactory manner to the public." 3 Elliot, 255.
In any event, those who promoted the 16th amendment sought to undermine federalism, our Constitution’s plan and its fair share formula with regard to taxes on “incomes”, and look what it has led to ___ a tyrannical system beyond belief which our founding fathers rejected. And now, Huckabee wants to likewise ignore federalism our Constitution’s plan and its fair share formula with a general tax among the states calculated from the sale of people’s property, real and personal, in spite of our founding fathers intentions and a written Constitution which both require our fair share formula to be applied to his tax so each state’s share can be determined as our Constitution commands.
It is so sad to realize that so few people in our Country really understand what “no taxation without representation” really means, which also means “representation with proportional obligation“, and yet, the formula is right there in our written Constitution, which was inspire to provide a specific protection against any general tax among the states, especially one based upon wealth, which in fact the alleged fair tax is, and is designed to have the people of the most productive states shoulder the major portion of a federal tax burden, but without their guarantee to a proportioned vote in Congress, equal to their contribution as our Constitution commands, and income taxation now subjugates. This is what socialism and “democracy” is all about, an endless assault upon the most productive, and, a mob rule vote in Congress when spending from the federal treasury. This is what our Constitution’s fair share formula was intentionally designed to protect against!
And so, it seems to me that Huckabee would have to violate the oath of office to adopt his alleged fair tax unless he is willing to work to have the following words added to our Constitution: The Congress shall have power to lay and collect taxes within the various states on the sale of property, real and personal, without apportionment among the several states, and without regard to any census or enumeration.
Is Huckabee, or the ringleaders behind the alleged fair tax, promoting such an amendment? That in itself ought to be a very clear signal to the lack of honesty behind the alleged fair tax.
Before he [the President] enter on the Execution of his Office, he shall take the following Oath or Affirmation:--"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."
If Huckabee were sincere about tax reform which would benefit the people, rather than folks in government, he would be promoting a simple amendment to our Constitution, which would bring us back to our FOUNDING FATHER’S ORIGINAL TAX PLAN as they intended it to operate ___ a plan created by tax rebels and designed to control the actions of Congress, rather than having Congress control the people: The Sixteenth Amendment is hereby repealed and Congress is henceforth forbidden to lay ``any`` tax or burden calculated from profits, gains, interest, salaries, wages, tips, inheritances or any other lawfully realized money
JWK If we can make the majority of America’s population dependent upon a monthly federal government check, [H.R.25`s "family consumption allowance" which Huckabee supports], we can then buy their vote, keep ourselves in power, and keep the remaining portion of America’s population enslaved to pay the bills. |
