I won't comment on Alito but fillibusters are appropriate when a minority concern is large. It basically evens the tables a bit if a few people feel motivated enough to filibuster. How many times had we hoped Republicans would fillibuster something when the Democrats were running the show? If Democrats feel something is important enough then they should do it. Worse comes to worse, Congress stops doing anything for a little while until either people get tired or they find a better consensus.
