So Webb shot off at the mouth, got the attention he wanted, and is reaping the benfits of having all of these new listeners tuning in to get angry at him or to hear what he'll say next.

Free speech.

Yeah, it was a stupid thing to say, but only because the likelihood of Dubya ever going on trial for war crimes is about on par with the likelihood that I'll wake up tomorrow fifty pounds lighter. If the national current were against him and it was even a possibility, then a few more people would be taking Webb's comment seriously, debating the finer points of the evidence, and placing their bets. If Dubya Was convicted, Webb would be a ballsy, outspoken genius who "broke" the issue to the public.

As it stands, he should not be in any legal trouble for his speech. Freedom of speech and all that. While I think it was an idiotic pointless comment, I'd be pretty pissed if he were in trouble for it.
