This involves planning and deliberation, but if the order to do so was lawfully made and the applicable standards of conduct and rules of war upheld, when perpetrated by a member of regular armed forces exempts the perpetrator from liability -this is true even if the order was unlawful, if the perpetrator was unaware of this. The difference is in the perpetrator, not the conduct. |
